INTERPRETATION

In this agreement

“Discount Card”                                  means a discount card and/or discount vouchers obtained, directly or indirectly, from ValueYou;

“Retailer”                                             means a restaurant, store or other provider of goods and/or services who is registered to accept a Discount Card or gift voucher;

“Gift vouchers”                                    means the various vouchers provided by participating retailers gifting either specific items e.g. meal, beauty treatment or with a monetary value

“ValueYou”                                          means ValueYou a charity registered in England & Wales (no. 1161760) and not for profit company registered in England and Wales (08701984)

“You” or “you”                                     means a recipient of a Discount Card or gift voucher (who shall be a person recognised as a volunteer with ValueYou through the application process).

 

1. Introduction

1.1. The terms and conditions set out below apply to the provision to you by ValueYou of the Discount Card and gift vouchers and the use by you of your Discount Card and gift vouchers.

1.2. Please read these terms and conditions carefully.

1.3. Once you have received your Discount Card you signify your agreement to be bound by these terms and conditions by using your Discount Card.

1.4. By using a gift voucher at a participating retailer you signify you agreement to be bound by these terms and conditions for the use of gift vouchers.

1.5. The Discount Card and gift vouchers are supplied to you on the basis of the information supplied to us by, or on behalf of, you in your Application Form.  ValueYou reserves the right to immediately and without notice cancel your Discount Card and gift vouchers at its absolute discretion for any reason whatsoever including, inter alia, if any information supplied to ValueYou by you is incorrect or misleading.

1.6. ValueYou has no relationship with the organisation for which you volunteer and provides the scheme separately from them through independent negotiations with local businesses.

1.7. If you are claiming Jobseekers Allowance/Universal Credit at the time of using the discount card and particularly any gift voucher we recommend you make the relevant declaration to your job centre supervisor.

1.8. ValueYou reserves the right to amend these terms and conditions at any time by publishing a notice on its website to that effect.

2. Expiry date and delivery of the discount card

2.1. The Discount Card will be valid until the expiry date printed on the front of the Discount Card. 

2.2. ValueYou will aim to send your personalised Discount Card to you by post within 14 days of receiving your application.

3. Using your discount card at participating restaurants and stores

3.1. ValueYou will use reasonable endeavours to maintain a list of those Retailers participating in the discount scheme on the ValueYou website but ValueYou does not warrant that any Retailer remains a participant or will accept a Discount Card.

3.2. Subject to these terms and conditions, on presentation of your Discount Card, participating Retailers will offer 10% off your total individual food bill or 10% off the total price of personal purchases, as the case may be.   Retailers reserve the right to refuse the Discount Card and the application of any discount for some or all of their goods and/or services at their absolute discretion.

3.3. Please check the terms and conditions of the particular offer you are interested in before making a purchase.

3.4. Where a Retailer requires you to pre-book (e.g. hairdresser, restaurant) you should state at the time of booking that you intend to use the Discount Card.

3.5. At a Retailer where you pay for goods after use (e.g. hairdresser, restaurant), with or without pre-booking, you should inform the Retailer that you intend to use the Discount card prior to the receipt of relevant goods/services

3.6. In all other circumstances you must inform the Retailer that you have a Discount Card immediately prior to the point of purchase (e.g. at the till).

3.7. You are not required to make an associated purchase or minimum spend when using the Discount Card.

3.8. The use of your Discount Card may not be available in conjunction with any other offers participating Retailers might be running.

3.9. The expiry date of your Discount card will be checked by participating Retailers when you redeem the offer. Expired Discount Cards will not be accepted.

3.10. Your Discount Card is strictly non-transferable and so cannot be used by either friends or family members or other third parties. Participating Retailers may ask you to show photo identification such as a driving licence or passport to confirm that you are the Discount Card holder or are permitted by law to make any acquisition. Any attempted misuse of the Discount Card will result in cancellation of the card.

3.11. Participating Retailers are entitled to withdraw their offer or change the terms and conditions of their offer from time to time. ValueYou shall have no liability for any such withdrawals or changes in their terms and conditions.

4. Choosing and collecting a gift voucher

4.1. When you are supplied with a Discount Card (and on other occasions as deemed appropriate by ValueYou) you will also be supplied with a unique gift voucher code that can be redeemed in exchange for a gift voucher provided by a participating retailer.
 
4.2. The available gifts will be displayed on our website (www.valueyou.org) and once chosen and the gift voucher code entered the relevant gift voucher will be provided for you to print and use.

4.3. When redeeming your gift voucher code you will be required to enter your name which will also be displayed on the gift voucher which is strictly non-transferable and so cannot be used by either friends or family members or other third parties. Participating Retailers may ask you to show photo identification such as a driving licence or passport to confirm that you are the rightful owner of the gift voucher or are permitted by law to make any acquisition. Any attempted misuse of a gift voucher will result in cancellation of the voucher.

4.4. The gift vouchers may only be redeemed before the expiry date displayed on the gift voucher (usually by the end of the month of collection) and when expired cannot be exchanged for an in date voucher.

5. Using your gift voucher at participating restaurants and stores

5.1. Subject to these terms and conditions, on presentation of your gift voucher the Retailer will provide the described item or credit for purchases for the described monetary value. Retailers reserve the right to refuse the redemption of the gift for some or all of their goods and/or services at their absolute discretion.

5.2. Where a Retailer requires you to pre-book (e.g. hairdresser, restaurant) you should state at the time of booking that you intend to use the gift voucher.

5.3. At a Retailer where you pay for goods after use (e.g. hairdresser, restaurant), with or without pre-booking, you should inform the Retailer that you intend to use the gift voucher prior to the receipt of relevant goods/services

5.4. In all other circumstances you must inform the Retailer that you have a gift voucher immediately prior to the point of purchase (e.g. at the till).

5.5. The use of your gift voucher may not be available in conjunction with any other offers participating Retailers might be running.

5.6. You are not required to make an associated purchase or minimum spend when using a gift voucher.

5.7. The expiry date of your gift voucher will be checked by Retailers when you redeem the offer. Expired gift vouchers will not be accepted.

5.8. Each gift voucher will also have a QR code printed on it which the Retailer may wish to check to ensure the voucher has not been used previously within the allowed time period.

5.9. Participating Retailers are entitled to withdraw their offer or change the terms and conditions of their offer from time to time. ValueYou shall have no liability for any such withdrawals or changes in their terms and conditions.

6. Liability

6.1. ValueYou will not be responsible for any indirect losses, consequential, exemplary, special or punitive damages, lost opportunities, loss of profits, anticipated profits, actual or anticipated savings.

6.2. ValueYou does not limit its liability at law for fraudulent misrepresentation or for death or personal injury caused by negligence or any other type of liability which cannot by law be excluded or limited.

6.3. Where you make a purchase using your Discount Card or use a gift voucher from any participating Retailer, any losses or liability arising out of or in connection with such purchases shall be the relevant participating Retailer’s liability. ValueYou does not accept liability for unsatisfactory experiences or any failure by the participating Retailers to deliver expected goods or services or the quality thereof.

6.4. ValueYou will not be under any obligation to become involved in any dispute between you and any participating Retailer. Any complaints should be taken up with the participating Retailer.

6.5. ValueYou does not give any warranty for any goods or services purchased with use of the Discount Card.

7. Waiver

7.1. Failure by ValueYou to enforce any of these terms and conditions will not prevent ValueYou from subsequently relying on or enforcing them.

8. Severability

8.1. If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

9. Third party rights

9.1. A person who is not party to these terms and conditions shall have no rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999.

10. Entire Agreement

10.1. These terms and conditions constitute the whole agreement between us and supersede all previous discussion, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions.

10.2. Each of the parties agrees that it has not entered into these terms and conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these terms and conditions or not) other than as expressly set out in these terms and conditions.

11. Law and jurisdiction

11.1. This agreement shall be interpreted in accordance with English law and will be subject to the non-exclusive jurisdiction of the English Courts.
